These terms and conditions apply when purchasing a theme or package from Organic Themes:

1. General Usage

With the purchase of any Organic Theme package, you are entitled to unlimited usage of the theme for yourself or client work. As a courtesy, we include design files with each Organic Theme — making it easier to meet the needs of your personal site, or providing an Organic Theme as a base for client work. Our themes are developed with this usage in mind. Organic Themes retains the right to change the terms and conditions and licensing of this site and our themes at any time.

2. Guarantee

Organic Themes are guaranteed to function correctly upon proper installation, activation and options configuration of the theme within the latest WordPress platform. We can not and do not guarantee compatibility with 3rd party plugins. If for some reason the theme is not working properly, report the issue to our support team, and we will do our best to resolve the problem in a timely manner.

3. Support Subscription

Organic Themes charges an annual support subscription fee at the same rate as the purchased product. The subscription is for ongoing theme support, updates, maintenance and account access. The subscription renews once per year from the date of purchase at the same rate as the purchased theme or package. The subscription may be canceled at any time within your account or through PayPal. Canceling a subscription will result in suspended access to download products from your account and suspended access to support resources after one year from your initial purchase date or last successful subscription renewal. Organic Themes is not responsible for the failure to cancel a support subscription in the event that it is no longer desired. Canceling a support subscription is the responsibility of the customer.

Note: A support subscription is not to be confused with a theme license. Canceling a support subscription will not affect your theme in any way.

4. Support

Support is provided for any theme purchased from Organic Themes for a year after the purchase date, or for as long as the annual subscription is renewed. Support includes the rectifying of issues arising from packaged theme features, bug fixes and basic usage questions. We do not provide support for our free themes; the use or issues arising from the use of 3^rd party plugins; troubleshooting issues occurring in versions of Internet Explorer older than version 9; WordPress itself; or customization. While we do not offer customization services, we are partnered with Werkpress and recommend their services for theme customization. Questions and inquiries should be directed to our support forum.

We are unable to provide support that requires us to view websites with questionable content. Such content includes, but is not limited to, pornography, prostitution, racist content, possible scams, etc.

Note: Support is offered Monday through Friday, 9AM to 6PM EST (UTC/GMT-5). Support requests are answered in order received.

5. Theme Setup Service

The Theme Setup Service is generally completed within 48 hours from receiving the necessary customer information requested via contact form upon the purchase of the service. The service includes the basic installation of WordPress and/or an Organic Theme, and it includes the setup of the WordPress theme as per the theme demo. In addition, we may upload and configure a single logo and background image for the site.

The Theme Setup Service does not include the creation of pages, posts, content, navigation items or anything outside of the theme demo content. It does not include any customizations or changes to the theme code. The Theme Setup Service should not be used for established websites with existing content.

If a Theme Setup Service is paid for and submitted with requests beyond the scope of the service as defined on the Organic Themes site, we will kindly ask that the request be modified to meet the requirements previously outlined. In the event the request cannot be modified to meet the theme setup requirements, we will provide a refund and the setup service will not be completed.

6. Refunds

We do not offer refunds for digital product sales or support subscription renewal fees. All sales are final. If there is an issue regarding a theme, we will address the problem. Unfortunately, there is no effective way for us to both combat fraud and issue refunds. We will be happy to answer questions regarding our themes before your purchase to insure it will meet your needs. Thank you for your understanding.

7. Licensing

The CSS, XHTML, PHP, design and any other elements of the themes downloaded from Organic Themes are released under the GPL license. They and are in total compliance to standards of that license as well as with WordPress. Our themes are not compatible with the wordpress.com blogging community. They are developed for individual installations of the WordPress platform.

8. Theme Compatibility

Currently our themes are designed to function properly with WordPress 3.5 and higher. It is our job to make sure the themes are up to date with the latest versions of WordPress. We cannot guarantee they will work properly on older installations of WordPress. We cannot guarantee the compatibility of our themes with all third party software and plugins. If a conflict does arise, we will do our best resolve the situation. Moreover, we cannot guarantee the themes will function correctly after modification to the code, or a failure to install the theme or WordPress properly.

9. Affiliates

Affiliates will be paid each month for the prior month of sales. You must have a verified PayPal account and accumulate at least 3 theme sales to receive affiliate payment from Organic Themes. Also, you must submit your W-9 or W-8BEN tax form, as well as your PayPal email address to [email protected] in order to receive payment.

We do not pay affiliates for the download of free themes, as there is no revenue generated. We do not pay affiliates for unsuccessful transactions. We do not support spamming or the use of fake promotions as an affiliate. Abuse of the Organic Themes affiliate program will result in nonpayment and removal from the program. We maintain close vigilance on each transaction and track where all sales are coming from. We highly encourage and reward affiliates that promote Organic Themes, but do not support dishonest sales tactics. Unacceptable tactics which will result in nonpayment and possible termination include, but are not limited to:

• Advertising coupon codes - including temporary promotional codes, expired codes, inaccurate discounts, or inaccurate payment details of any kind. Any coupon promotions are created for the benefit of our customers, not our affiliates.
• Misrepresenting or inaccurately describing Organic Themes services, products, brand, or trademark.
• Misleading referred users in a manner which implies the inclusion of any product, service, or experience beyond that expressly depicted on organicthemes.com.
• Affiliates that sign up for the program and refer themselves for a discount on our products.
• Failure to have your PayPal email address within our records in the form of an affiliate application or email notification, as we are likely to suspect fraud in this scenario.
• Fraudulent form leads.

If we have any reason to suspect fraud the affiliate will not be paid and the account will be terminated.
